These Terms of Service (the “Terms”) are a binding agreement between you (“you”, “your”, the “Customer”) and Craft Studio Katina and Love, a California sole proprietorship (“Craft Studio Katina and Love”, “we”, “us”, “our”), operating the website at katinaandlove.com and the online store at shop.katinaandlove.com (together, the “Site”). By creating an account, purchasing a masterclass, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund Policy. We sell pre-recorded, on-demand digital video masterclasses in sewing, knitting, and related handcraft skills (the “Courses”), together with any downloadable supplementary materials such as patterns or material lists (the “Course Materials”). 4.1 Prices. The price of each Course is the fixed amount displayed on that Course’s page and confirmed at checkout, in U.S. dollars. The displayed price is the price you pay. We do not advertise “starting from” prices and we make a genuine, good-faith offer to sell every Course at the price shown. 4.1 Precios. 4.2 Taxes. Our Courses are delivered electronically by streaming over the Internet, with no physical media. Under current California Department of Tax and Fee Administration guidance (Publication 109), such electronically delivered products are generally not subject to California sales or use tax, and we do not add California sales tax to digital Course purchases. You are responsible for any tax that may apply to your purchase under the laws of your own jurisdiction. 4.2 Impuestos. 4.4 Order confirmation. Access to a purchased Course is provided immediately after your payment is confirmed (see Section 5). 5.1 Courses are digital products delivered instantly. There is no carrier shipment, and the federal Mail, Internet, or Telephone Order Merchandise Rule shipment timeframes do not apply to instant streaming access. 5.1 Los Cursos son productos digitales entregados de forma instantánea. 6.1 License granted. When you purchase a Course, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable license to stream and view that Course and to use its Course Materials for your own personal, non-commercial learning. You are buying access to view the Course, not ownership of the underlying video files or intellectual property. 6.1 Licencia otorgada. 6.2 “Yours Forever” meaning. “Yours Forever” means we will not charge you again and will not place your purchased Course behind a subscription. Your access continues for the operational lifetime of the Site. If we ever decide to permanently discontinue the Site or a purchased Course, we will give you at least 60 days’ advance notice by email to the address on your account and will make a reasonable effort, to the extent commercially and technically feasible, to provide a personal-use download of the Course you purchased before access ends. This commitment exists specifically so that buyers are not left without the content they paid for. 6.2 Significado de “Suyo para Siempre”. “Suyo para Siempre” significa que no le cobraremos nuevamente y no pondremos su Curso comprado detrás de una suscripción. You may not, and may not permit others to: (a) download, screen-record, copy, rip, or capture the Courses except as expressly offered through a Site download feature; (b) share, resell, rent, sublicense, publicly perform, broadcast, or redistribute the Courses or Course Materials; (c) share your account credentials or signed video links; (d) circumvent or attempt to circumvent any access control, signed-URL, or watermark; or (e) use the Courses to create a competing instructional product. Course Materials such as patterns are for your personal craft use; finished physical items you make for yourself or as gifts are yours, but you may not mass-produce items for commercial sale using our patterns without our written permission. 6.3 Restricciones. 6.4 Ownership. All Courses, Course Materials, video, text, graphics, the “Craft Studio Katina and Love” name and logo, and the Site design are owned by Craft Studio Katina and Love or its licensors and are protected by intellectual-property laws. No rights are granted except as expressly set out in these Terms. 6.4 Propiedad. You agree not to: misuse the Site; attempt to gain unauthorized access to any account, server, or data; upload malicious code; interfere with the Site’s operation; or use the Site for any unlawful purpose. We may suspend or terminate access that violates these Terms or that we reasonably believe is fraudulent or harmful, and we may pursue available remedies for piracy or unauthorized distribution. 8.1 The Courses are provided for general educational and informational purposes. Craft skill outcomes depend on your own practice and materials; we do not guarantee any particular result, skill level, or income. 8.1 Los Cursos se proporcionan con fines educativos e informativos generales. 8.2 Crafting involves tools that can cause injury (for example sewing machines, needles, scissors, and cutting tools). You are responsible for following all manufacturer instructions and basic safety precautions, for using appropriate adult supervision when minors are present, and for working within your own ability. 9.1 The Site and Courses are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. You agree to indemnify and hold harmless Craft Studio Katina and Love from third-party claims, losses, and reasonable expenses arising out of your breach of these Terms or your unlawful or infringing use of the Courses, except to the extent caused by us. 11.2 We may update these Terms. If we make a material change, we will post the updated Terms with a new Effective Date and, where reasonable, notify account holders by email. 12.3 If the matter is not resolved, the state and federal courts located in Sacramento County, California will have jurisdiction, except that either party may bring an individual claim in small-claims court. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Site and Courses.
